1. Operator and scope

The website is operated by Argelis Holguin, an individual based in the United States, operating under the trade name 3menda Batalla. Contact: info@3mendabatalla.com. These terms govern use by visitors, applicants, voters, and brands. The Official competition rules govern the competition and control sporting matters; sponsorships are also governed by their signed agreements. The Privacy policy explains data processing.

2. Access and acceptance

Applications and voting require a minimum age of 18. Before paying, submitting an application, or voting, you may review the applicable conditions, and your acceptance will be recorded through the relevant action. Anyone acting for a brand must be authorized to represent it. Provide accurate information, keep it current, and protect your codes and credentials. Do not share access to the administration panel or use someone else’s account.

3. Acceptable use

You may not manipulate votes, evade verification, create false identities, automate prohibited actions, introduce malware, access systems without authorization, disrupt service, or collect other users’ personal data without permission. You may not upload unlawful, threatening, discriminatory, sexually explicit, harassing, or personally abusive content or disclose private information without authorization.

The Organizer may restrict an account, remove materials, or void operations for a documented violation or security risk. Where possible it will explain the reason and allow review requests at info@3mendabatalla.com. Sporting sanctions and refunds are governed by their specific policies.

4. Participant and brand content

Anyone submitting photographs, videos, text, music, logos, or advertisements represents that they own the necessary rights or have adequate permission, including permissions from identifiable people. Ownership is not transferred. Participant permissions are those in the Official rules; brand permissions are limited to delivering and documenting the agreed sponsorship. Third-party works, brands, or barbering work may not be presented as your own.

To report infringement, email info@3mendabatalla.com with contact information, identification of the work or right, a link to or location of the material, and an explanation of your ownership or authority. Reports will be investigated, and material removed or restricted where appropriate.

5. Payments and external services

Website payments are processed through Stripe, subject to its terms, controls, and availability. Stripe’s presence does not mean it endorses the competition or guarantees its results. The Organizer remains responsible for the contracted service and any required refunds.

The payment description, currency, total, and cancellation terms will be displayed before payment. Application fees are charged in US dollars. Charges appear on card statements as WWW.3MENDABATALLA.COM (short version: 3MENDA). The Organizer does not store full card numbers or security codes; it may receive transaction references, status, and limited transaction information. Broadcasts, links, and third-party pages have their own terms.

6. Availability and liability

The website may experience interruptions, maintenance, or errors. The Organizer will make reasonable efforts to resolve problems and protect competition integrity, without guaranteeing uninterrupted availability. It does not guarantee qualification, audience, revenue, or commercial results for competitors or brands.

To the extent permitted by law, the Organizer is not liable for indirect loss, lost profits, or failures of third-party connections or services not attributable to it. This limitation does not exclude liability for fraud, willful misconduct, gross negligence, or other liability that cannot lawfully be limited, and does not eliminate committed prizes, refunds, or services. Users must operate their tools and workspace safely.

7. Amendments and final provisions

Changes will state their effective date. Material changes will be prominently announced and, where appropriate, emailed before taking effect; renewed acceptance will be requested when necessary. They will not be used to retroactively reduce acquired rights. If a provision cannot be enforced, the remaining provisions will continue to the extent legally permitted.

New York State and United States federal law apply, subject to mandatory protections and forums in the user’s place of residence. Disputes will be brought before competent New York courts unless another mandatory forum applies. Questions and complaints: info@3mendabatalla.com.
